POLICY AND TERMS AGREEMENT STATEMENT
Acknowledgment of this POLICY AND TERMS AGREEMENT STATEMENT shall serve as
our confirmation of your order for service from J&J COMMUNICATIONS, LLC, and
your acceptance of the order including acceptance of the following Terms and
Conditions. This acknowledgment authorizes J&J COMMUNICATIONS, LLC to
provide you with wireless services for the Period agreed to below.
J&J Communications, LLC reserves the right to revise, amend, or modify this
AUP, our Service Agreement and our other policies and agreements at any time
and in any manner. Notice of any revision, amendment, or modification will
be posted in accordance with the Service. J&J Communications, LLC shall be
entitled to assign this Agreement either in whole or in part.
The User undertakes that he/she will not assign, re-sell, sub-lease or in
any other way transfer his/her rights or obligations under this Agreement.

BY USING THESE SERVICES, (i) YOU ACKNOWLEDGE THAT YOU ARE AN ADULT (18 YEARS
OR OLDER) AND (ii) YOU HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS AND
AGREE TO BE BOUND BY THE TERMS AND CONDITIONS IN EFFECT AND AS UPDATED BY
J&J COMMUNICATIONS, LLC FROM TIME TO TIME. IN ADDITION, BY PLACING AN ORDER
FOR THE SERVICES, YOU ACKNOWLEDGE THAT J&J COMMUNICATIONS, LLC WILL COMMENCE
PROCESSING SUCH ORDER AND WILL INCUR EXPENSES AND OBLIGATIONS IMMEDIATELY.
IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS AND CONDITIONS, YOU MAY NOT USE
THE SERVICES AND YOU SHOULD CANCEL YOUR ORDER. IF YOU DO NOT AGREE TO BE
BOUND BY THE TERMS AND CONDITIONS, J&J COMMUNICATIONS, LLC WILL BE UNDER NO
OBLIGATION TO PROVIDE YOU WITH THE SERVICES.
THE TERMS AND CONDITIONS ARE SUBJECT TO REVISION FROM TIME TO TIME. THE
LATEST VERSION OF THE TERMS AND CONDITIONS MAY BE FOUND AT

FOR PURPOSES OF THE TERMS AND CONDITIONS, YOU WILL BE REFERRED TO AS THE
"CUSTOMER."
INTRODUCTION TO THE "USE OF OUR SERVICES POLICY"
J&J Communications, LLC' Acceptable Use Policy "AUP" is intended to help
enhance the use of our Intranet by preventing unacceptable use. All users of
J&J Communications, LLC's Intranet "Services" those who access some of our
Services but do not have accounts "Visitors" as well as those who pay a
monthly service fee to subscribe to the Services "Members" must comply with
this AUP. We support the free flow of information and ideas over the
Intranet and do not actively monitor use of the Services. We do block
certain TCP and UDP and IP ports that we feel are needed to protect our
network. We do not exercise editorial control over the content of any Web
site, electronic mail transmission, news group, or other material created or
accessible over or through the Services, except for certain proprietary
websites. We may remove any materials that may be illegal, may subject us to
liability, or which may violate this AUP. J&J Communications, LLC may
cooperate with legal authorities and/or third parties in the investigation
of any suspected or alleged crime or civil wrong. Violation of this AUP may
result in the suspension or termination of either your access to the
Services and/or your J&J Communications, LLC account or other actions. This
AUP should be read in conjunction with our Intranet Service Agreement, our
TERMS AND CONDITIONS below and our TERMS AND CONDITIONS document in full
text.
SERVICE AND BILLING POLICIES
J&J Communications, LLC, Intranet Access provided by J&J Communications, LLC
to the customer is to be used for the sole purpose of Intranet Access. We
reserve the right to monitor the connection with prudence and cancel or
terminate the connection if we reasonably believe that the customer is using
the connection for other purposes, other than Intranet access, without our
express permission and understanding. Customer is still liable for the
remainder of the contract if they are terminated in the aforementioned
manner. The customer does have the option, however, to upgrade their account
to one of our other packages without affecting the contract terms. A one
time setup fee may be charged for service changes.
EQUIPMENT - CUSTOMER RESPONSIBILITY
THE EQUIPMENT FURNISHED BY J&J COMMUNICATIONS, LLC AS A RENTAL IS AND SHALL
REMAIN THE SOLE AND EXCLUSIVE PROPERTY OF J&J COMMUNICATIONS, LLC (customer
owned equipment and the Ethernet card excluded). J&J Communications, LLC or
its authorized agents may remove all equipment at any time following the
termination of this agreement for any reason. At the time of cancellation
the customer has thirty days to return all equipment to J&J Communications,
LLC at P.O. Box 63043, West Rushville, OH 43063. If J&J Communications, LLC
has to go and retrieve any equipment, the customer will incur a $75.00
charge, and if the customer does not return the equipment at all (or allow
J&J Communications, LLC to retrieve said equipment,) the customer will incur
a $400.00 charge.
1. Customer shall acquire no interest in wireless transceiver boxes or any
other equipment by virtue of any payments made thereto, or otherwise.
2. Customer agrees if they make repairs or otherwise alter or disturb or
tamper with the wireless transceiver box or other cables and equipment
and/or software drivers or network configuration then J&J Communications,
LLC reserves the right to charge normal service rates to get equipment
and/or software drivers-configuration back up to working order. Only J&J
Communications, LLC or its authorized representatives are permitted to
perform any work on such equipment. J&J Communications, LLC or its
authorized representatives shall perform reasonable repairs and service
calls concerning the equipment under normal warrantee procedures. Service
does not necessarily include replacement of used or worn cables, connectors,
ends, wrapping or other items listed on form. Outdoor equipment, cable,
connectors, and other items have a life expectancy and may need to be
replaced over time which is the responsibility of the Customer.
3. Customers that do a self-install take responsibility for all equipment
but not limited to Wireless Bridge Is, cabling, POE (Power Over Ethernet),
Power Adapter, for 90 days from delivery of said equipment. After the 90
days J&J Communications, LLC will take all responsibility of all said
equipment. J&J Communications, LLC will deliver and show customer that all
said equipment is in good working condition.
LATE FEES - COLLECTION AND RECONNECTION CHARGES
1. At the time of cancellation the customer has thirty days to return all
equipment to J&J Communications, LLC at P.O. Box 63043, West Rushville OH. 43163. Customer is responsible for all
shipping charges. If J&J Communications, LLC has to go and retrieve any
equipment, the customer will incur a $75.00 charge, and if the customer does
not return the equipment at all (or allow J&J Communications, LLC to
retrieve said equipment,) the customer will incur a $400.00 charge.
2. Reconnection following disconnection for non-payment will require payment
of any existing balance, including late charges, a reconnection
charge and an advance of one month's service charges.
3. Customers may be charged a processing fee for any checks returned due to
insufficient funds.
RESPONSIBILITY FOR ACCOUNT
1. Customer is responsible for all use of Customer's account in all
circumstances under any username or password used on that account. It is the
sole responsibility of the Customer to protect the confidentiality of
Customer's password.
2. If at any point in time J&J Communications, LLC discovers that the
Customer is 'sharing' their network connection, without the express
permission of J&J Communications, LLC, then Customer will be subject to a
$100,000.00 fine plus any legal fees.
3. Customer expressly agrees that the use of the service is at the sole risk
of the Customer. Customer's choice to view or access any content or
materials through the use of J&J Communications, LLC and its equipment is
made at the sole discretion of the Customer. Customer agrees to defend,
indemnify and hold harmless J&J Communications, LLC, its affiliates and
third party content and information service providers, and their respective
officers, directors employees and agents, from and against all claims and
expenses, including attorney's fees, either arising out of the Customer's
use of the service or the use of Customers account.
4. Customer may terminate service at any time after contract term with a 30
days advance notice in writing using the appropriate E-mail cancellation
address, and return all equipment within 15 days of termination date to J&J
Communications, LLC, When relocating, Customers must call for a
disconnection at least 2 weeks in advance. Customer remains responsible for
payment of all service prior to disconnection, and for any payment remaining
after arrangements are made for a J&J Communications, LLC representative to
pick up a wireless transceiver box(s), a trip charge may be assessed.
VIOLATIONS OF J&J Communications, LLC ACCEPTABLE USE POLICY
THE FOLLOWING CONSTITUTES VIOLATIONS OF THIS AUP:
a. Illegal use. Using the Services to transmit any material (by email,
uploading, posting, or otherwise) that, intentionally or unintentionally,
violates any applicable local, state, national or international law, or any
rules or regulations promulgated hereunder.
b. Harm to minors. Using the Services to harm, or attempt to harm, minors in
any way.
c. Threats. Using the Services to transmit any material (by email, uploading,
posting, or otherwise) that threatens or encourages bodily harm or
destruction of property.
d. Harassment. Using the Services to transmit any material (by email,
uploading, posting, or otherwise) that harasses another.
e. Fraudulent activity. Using the Services to make fraudulent offers to sell
or buy products, items, or services or to advance any type of financial scam
such as "pyramid schemes," "Ponzi schemes," and "chain letters."
f. Reselling the services. Reselling the Services without J&J
Communications, LLC’ authorization.
g. Network disruptions and unfriendly activity. Using the Services for any
activity that adversely affects the ability of other people or systems to
use J&J Communications, LLC Services.
h. Unauthorized access. Using the Services to access, or to attempt to
access, the accounts of others, or to penetrate, or attempt to penetrate,
security measures of J&J Communications, LLC's or another entity's computer
software or hardware, electronic communications system, or
telecommunications system, whether or not the intrusion results in the
corruption or loss of data.
